Title Verification for Due Diligence Purposes
If you are buying a property and will be investing a significant amount of money, a prudent move would be to verify, based on the Title,whether the area (in square meters) as stated in the Title, is the same as the actual area of the property, based on a land survey.
It’s also good to verify that the location of the property as stated in the title description of the Title (which is stated in degrees, Northwest, Southwest, etc. which many people don’t really understand) is the same as the actual location. It may be that the address in the Title is in Pasig but in reality, it is in Marikina or some other place. Incidentally, if there is a problem in the technical description (the polygon does not close, etc.), OMI can also fix it for you.
It would also be good to check the ownership history of the Title and see if the records match the tax declaration, survey plans, etc. A traceback would also be good if you want to see the annotations in the previous title (for example, how much the property was mortgaged to the bank).

Title Transfer
Transferring a Title is very tedious and time-consuming. If you’re not really sure of the steps, you will end up going back and forth because you lack some documents or signatures. You need to go to different government agencies and you have to fall in line many times. If you have a full-time job or are very busy with more pressing concerns, you may want to consider outsourcing the title transfer to OMI.

Lost your copy of the title and don’t know what to do?
The process you need to undergo is Reconstitution of your land title. Reconstitution is the restoration of the instrument or title allegedly lost orย destroyed in its original form and condition.
Administrative reconstitution applies when there is substantial loss orย destruction of land titles, due to fire, flood or other force majeure where theย number of certificates of title lost or damaged is at least ten percent (10%) of theย total number of titles in custody of the Registry of Deeds, but theย number of lost titles should not be less than 500.ย Judicial reconstitution applies when individual file copies of the certificate of titleย are lost or destroyed in the Registry of Deeds.

Hi. Pls. help us Atty. Four of us (all family members with diff. %tage share each) recently bought a Metro Mla lot. Per verification, ok po lahat including ownership. Only problem is incomplete po ang Tech. Description sa TCT. It says “Full technical description appears on TCT No. xxxx”. We were not able to get a copy of said TCT from the RD, LRA(Micrographics Section) and from Binangonan. Neither were we able to get a copy of the subdivision plan(Psd xxxxx)from LRA Docket Section (Rm 107), LMB(DENR) East Ave nor from LMB Escolta. Result of the traceback conducted shows the same notation on the two cancelled TCTs prior to the current one. I had the lot resurveyed, got certified true copies of TCTs & Tax Decs of 2 adjacent lots, and will file the survey plan for approval. After approval, ipapainscribe daw. How will this be done? Will it be thru the Court? How much po will be the probable cost(our purchase price is about P4.5M)? How long will the Court’s decision be? Is there another way/s to have the Tech Desc inscribed without going thru the Court? And is there another way to secure/locate the missing Tech Desc./TCT? Thank you

How much your expenses Sir Jay after they fixed your problem?
If I remember correctly my total cost for the transfer (service fee) was Php15K. Of course I also shouldered the taxes, fees, and other out of pocket expenses. Take note, this was before the LRA computerization, so if it was a typo error, it was easier to fix.
